Terms of Service

  1. Definitions

    In these Terms: "Agreement" means these Terms of Service; "Company" means Nordhash Oy (Business ID 3535584-8); "Service" means the remote hosting, operation and monitoring of physical Bitaxe Gamma hardware for rental; "Customer" means the person or legal entity renting hardware from the Company; "Hardware" means the Bitaxe Gamma mining device provided by the Company; "Pool" means the mining pool chosen by the Customer; "Wallet" means the Bitcoin address specified by the Customer for informational purposes only.

  3. Service Description

    The Company provides physical hardware rental (Bitaxe Gamma) with hosting, electricity, internet connectivity, and remote monitoring. The Service is strictly hardware rental and hosting. Customers configure their own mining pool and wallet; the Company does not control or custody cryptocurrencies.

  4. Rental Process

    Rentals are initiated by Customer selecting a plan and completing payment through the provided payment channels (for example SumUp). After payment, the Customer must submit configuration details (pool, worker, wallet) through the Company’s setup process. The rental is only activated after the Company has received the necessary configuration details and has allocated hardware to the Customer.

  5. Eligibility

    Customers must be at least 18 years old and have legal capacity to enter binding contracts under applicable law. The Service is not offered to persons or entities subject to trade restrictions or sanctions.

  6. Customer Responsibilities

    The Customer is responsible for providing accurate contact, payment, pool and wallet information, maintaining control of their wallet keys, and complying with applicable laws when operating mining operations. The Customer must not provide wallet keys, private keys, or any credentials that would enable the Company to control Customer funds.

  7. Customer Account

    If the Service requires account registration, the Customer is responsible for maintaining the confidentiality of account credentials and for all activity under their account.

  8. Payment

    Payments are collected via the payment service providers identified on the website. The Company is not a payment provider. All payments must be made in the currency specified at checkout. The Company is not liable for payment provider outages or processing errors beyond its direct control.

  9. Pricing

    Prices are shown on the website and are exclusive of any taxes or duties unless explicitly stated otherwise. The Company may change prices for new rentals; changes do not affect already-paid rental periods except as required by law.

  10. Taxes

    The Customer is responsible for any taxes, duties or fees applicable to their use of the Service under their local law. The Company will collect and remit taxes where required by applicable law.

  11. Rental Activation

    Activation occurs after payment and after the Customer has submitted required configuration details and the Company has allocated hardware. Activation times are estimates; the Company aims to activate rentals as soon as practicable and typically within 12 hours subject to capacity.

  12. Rental Duration

    The rental term is the duration selected at purchase. Renewals are subject to availability and separate payment.

  13. Service Availability

    The Company endeavors to maintain Service availability but does not guarantee uninterrupted operation. See sections on Uptime, Maintenance and Liability.

  14. Hosting

    The Company provides physical hosting of rented hardware at its facilities. The Company controls the physical environment but does not control the Customer's pool or wallet.

  15. Electricity

    Electricity for operation of the rented hardware is included in the rental price, subject to reasonable usage and the Company’s acceptable use policies.

  16. Internet Connectivity

    The Company supplies internet connectivity sufficient to operate the hardware. The Company is not liable for third-party connectivity outages outside its direct control.

  17. Maintenance

    The Company performs routine and emergency maintenance required to operate and secure hardware. The Company will notify Customers of planned maintenance where reasonably practicable.

  18. Planned Maintenance

    Planned maintenance windows will be scheduled to minimize customer impact. The Company will provide advance notice when feasible.

  19. Emergency Maintenance

    Emergency maintenance may occur without advance notice to protect hardware, network or third parties. The Company will restore the Service as promptly as possible.

  20. Hardware Replacement

    If hardware fails, the Company will attempt repair or replacement subject to availability. Replacement timelines depend on spare inventory and logistics.

  21. Downtime

    Downtime due to maintenance or failures may occur. The Company will use reasonable efforts to minimize downtime but does not guarantee zero downtime.

  22. Customer Configuration

    The Customer is responsible for configuring the mining pool and providing correct worker and wallet information. Incorrect configuration by the Customer is not the Company’s responsibility.

  23. Mining Pool Configuration

    The Customer selects and configures the mining pool. The Company does not manage or operate mining pools and is not responsible for pool performance or policies.

  24. Wallet Configuration

    The Customer configures their wallet and receives mining rewards from the pool to their wallet. The Company never holds or controls Customer cryptocurrencies or wallet private keys.

  25. Third-Party Services

    The Service relies on third-party providers (payment processors, network providers, pools). The Company is not responsible for third-party availability or performance beyond the Company’s contractual obligations with those providers.

  26. Mining Rewards

    Mining rewards are paid by the pool to the Customer’s specified wallet. The Company does not receive mining rewards on behalf of Customers.

  27. Bitcoin Network Risks

    Customers bear risks associated with the Bitcoin network, including protocol changes, forks, and other consensus events that may affect mining outcomes.

  28. Cryptocurrency Risks

    Cryptocurrency values are volatile; the Company does not provide investment advice and does not guarantee financial returns.

  29. No Guaranteed Hashrate, Uptime, Rewards or Profitability

    The Company makes no guarantees about hashrate, uptime, mining rewards, or profitability. Mining performance depends on network difficulty, luck, pool performance, and hardware uptime.

  30. Acceptable Use

    Customers must use the Service lawfully and not for unlawful or abusive activities. The Customer must not provide wallet private keys or credentials that would allow the Company to access Customer funds.

  31. Prohibited Activities

    Prohibited activities include using the Service for illegal operations, fraud, money laundering, or activities that violate applicable laws or network rules.

  32. Suspension

    The Company may suspend Service for security reasons, suspected illegal use, or to prevent harm. The Company will notify the Customer where feasible.

  33. Termination

    Either party may terminate for material breach. Termination rights for Consumers are subject to mandatory consumer protection law and the Refund Policy.

  34. Force Majeure

    The Company is not liable for delays or failures caused by circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, government actions, third-party outages, or supply chain disruptions.

  35. Intellectual Property

    All intellectual property in the Company website and Service remains the Company's property. Customers are granted a limited right to use the Service for the rental term.

  36. Warranty Disclaimer

    To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, whether express or implied.

  37. Limitation of Liability

    The Company’s liability to Customers for direct loss arising from the Service is limited to direct damages up to the total amount paid by the Customer for the affected rental term. The Company is not liable for indirect, incidental, or consequential damages, including lost profits or lost mining rewards, except as required by mandatory law.

  38. Maximum Liability

    The maximum aggregate liability of the Company under or in connection with these Terms is limited to the amount actually paid by the Customer for the relevant rental during the 12 months preceding the claim, except in cases of gross negligence or willful misconduct to the extent permitted by law.

  39. Indirect Damages

    The Company is not liable for indirect damages, including loss of business, loss of profits, or reputational harm, except where prohibited by mandatory law.

  40. Governing Law

    These Terms are governed by and construed in accordance with the laws of Finland. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Finnish courts, subject to mandatory consumer protection rules for Consumers.

  41. Consumer Rights

    Consumers retain statutory rights under Finnish and EU consumer protection legislation. Nothing in these Terms is intended to restrict mandatory statutory rights of consumers under applicable law.

  42. Consumer Dispute Resolution

    For consumer disputes, Customers may contact the Finnish Consumer Advisory Services and may submit a dispute to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta). Further information is available at https://www.kuluttajariita.fi. Nothing in these Terms limits any mandatory consumer rights or dispute resolution procedures available under applicable law.
